Food item hurled by demonstrator reportedly shattered and caused mustard stain on customs official, court hears
A US immigration agent has testified he could feel through his body armor the collision of a food product launched at him by a capital city activist, who has faced court proceedings for assault.
Federal border agent the government official testified to the jury the snack "burst all over him" and he "detected the vegetables and yellow sauce" on his work clothing.
Both legal teams challenges that Sean Dunn, thirty-seven, did in fact throw vulgar language and a prepared food item at authorities deployed by the former president to monitor the Washington DC in the summer month.
The incident was captured on video and spread across the internet, making the defendant a symbol of protest in the federal district to Trump.
Government prosecutors originally tried to achieve serious criminal counts against the accused, but a judicial committee refused to charge him.
Trump's assignment of National Guard troops to Washington DC this warmer months sparked protest from some of the DC citizens, who viewed it as a political use of the armed forces.
Based on charging documents, the defendant approached a law enforcement team at about late evening on 10 August, describing them "fascists" and yelling: "Why are you here? Your presence is unwanted in my city!"
The legal proceeding observed a reenactment from the officer on Tuesday as he gave evidence against the accused.
"I sensed it through my ballistic vest," he stated of the sandwich's impact, mentioning that an onion string dangled from his communication device and sauce stained his shirt.
The defendant's attorney, Julia Gatto, stated in her court presentation that hurling the food item was a "non-threatening act that did not, could not, cause injury".
But government attorney John Parron maintained the accused must be considered responsible.
"No matter who you are, you can't just go around hurling objects at others because you're upset," the prosecutor said.
Following the reported incident was revealed, the defendant was dismissed from his position as a legal assistant in the government law department.
